These Terms of Service ("Terms") govern your use of the Exmoorweb website (www.exmoorweb.co.uk), our web design and development services, hosting services, customer portal, and all related tools and features. By using our website or services, you agree to these Terms.

We offer the following services:

• Website Hosting — managed hosting with ongoing maintenance and support
• Free Website Offer — professional website built at no upfront cost, with monthly hosting fee
• Free AI-Powered Proposals — automated website proposals generated using AI
• SEO & Digital Marketing — search engine optimisation and related services
• E-Commerce Solutions — online store development
• Customer Portal — self-service portal for invoices, support, documents, AI tools

3. Free Website Offer

3.1 The Offer

We build a professional website at no upfront cost. You pay a monthly hosting fee of £20/month (or the price agreed at time of signup). This includes hosting, maintenance, security updates, and standard support.

3.2 What You Get

• A custom-designed, mobile-responsive website
• Managed hosting with SSL certificate
• Ongoing maintenance and security updates
• Email support

3.3 Availability

Free website spots are limited each month. Availability is shown on our website and is subject to change without notice. Submitting a claim does not guarantee a spot until confirmed by us.

3.4 Content Ownership

• Your content — text, images, branding, and logos you provide remain yours
• Website design and code — provided as part of the hosting service and remain the property of Exmoorweb while hosting is active
• If you cancel hosting, you retain all your content and are free to use it elsewhere. The website design and code are not transferable

4. AI-Powered Features

4.1 Free Proposal Tool

Our AI-powered proposal tool generates website designs and recommendations based on information you provide. Proposals are for demonstration purposes and do not constitute a binding quote. Final pricing and scope are confirmed separately.

4.2 AI Assistant & Insights

The customer portal includes AI-powered features for website analysis and business assistance. These features:

• Are provided "as is" and for informational purposes only
• May occasionally produce inaccurate or incomplete information
• Should not be relied upon as professional business, legal, or financial advice
• Are subject to monthly usage credits as specified in your plan

4.3 Acceptable Use of AI Features

You agree not to:

• Use AI features to generate harmful, illegal, or deceptive content
• Attempt to extract or reverse-engineer our AI prompts or systems
• Exceed your allocated usage credits through automated or bulk requests
• Use generated content to compete directly with our services

5. Payments

5.1 Payment Methods

We accept the following payment methods:

• Direct Debit — via GoCardless, protected by the Direct Debit Guarantee
• Card payments — via Stripe (Visa, Mastercard, etc.)
• Manual payments — bank transfer by arrangement

5.2 Billing

• Monthly hosting fees are collected on or around the 1st of each month
• One-time invoices (e.g. for additional work) are due within 14 days unless otherwise agreed
• All prices are in GBP (£) and inclusive of VAT where applicable

5.3 Failed Payments

If a payment fails, we will notify you by email and attempt to collect again. If payment remains outstanding after 30 days, we reserve the right to suspend your website and services until the balance is cleared.

5.4 Refunds

• Direct Debit payments are protected by the Direct Debit Guarantee — you can claim a refund from your bank at any time if there is an error
• Monthly hosting fees are non-refundable for the current billing period
• Refunds for custom development work will be considered on a case-by-case basis

6. Cancellation

6.1 Your Right to Cancel

• You may cancel your hosting at any time — there is no minimum contract
• To cancel, email us at marcus@exmoorweb.co.uk or raise a support ticket in your portal
• Your website will remain live until the end of your current paid period
• After cancellation, your website will be taken offline and data retained for 30 days before deletion

6.2 Our Right to Cancel

We reserve the right to suspend or terminate your service if:

• Payment remains outstanding for more than 30 days
• Your website contains illegal, harmful, or abusive content
• You breach these Terms of Service

We will provide at least 14 days' notice before any termination (except in cases of illegal activity).

7. Customer Portal

7.1 Account Security

• We use passwordless authentication (magic links) for portal access
• You are responsible for keeping your email account secure, as it is the sole method of authentication
• Portal sessions expire after 2 hours of inactivity

7.2 Uploaded Content

• You may upload documents, images, and other files through the portal
• Maximum file size is 100MB per upload
• You warrant that any content you upload does not infringe third-party rights
• We reserve the right to remove content that violates these Terms

8. Website Design Services (Custom Projects)

8.1 Quotations

All custom project quotations are valid for 30 days from issue unless otherwise stated. Quotations are estimates and final costs may vary if the scope of work changes.

8.2 Design Approval

• We will provide draft designs or previews for your feedback
• Up to 2 rounds of design revisions are included as standard
• Additional revision rounds may incur extra charges

8.3 Project Timelines

Timelines provided are estimates based on current workload. Delays caused by late provision of content or feedback by the client will extend the timeline accordingly. We are not liable for losses resulting from delayed project completion.

8.4 Intellectual Property

• Upon full payment, you receive a licence to use the website design for your business
• We retain the right to showcase completed work in our portfolio unless you request otherwise in writing
• Third-party assets (stock images, fonts, libraries) are subject to their own licences

9. Acceptable Use

You agree not to use our website or services to:

• Upload, store, or distribute illegal, harmful, defamatory, or obscene content
• Send spam, phishing, or unsolicited communications
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with the performance or availability of our services
• Violate any applicable laws or regulations
• Scrape, harvest, or collect data from our website through automated means

10. Limitation of Liability

• Our services are provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, or consequential losses arising from the use of our services
• Our total liability for any claim shall not exceed the total fees paid by you in the preceding 12 months
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law

11. Uptime & Backups

• We aim for 99.9% website uptime but do not guarantee it
• We perform daily backups of hosted websites
• While we take every reasonable precaution, we are not liable for data loss. We recommend you keep your own copies of important content

12. Third-Party Services

Our website and services integrate with third-party providers including GoCardless, Stripe, Google Analytics, Google reCAPTCHA, and Anthropic AI. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party service outages or changes.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy. By using our services, you acknowledge you have read and understood our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active customers by email. Continued use of our services after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
